, Y, <br /> . � , . . <br /> ��- � ``��� ��o� Cit o� ORONO <br /> . c <br /> �� � <br /> • � ��' � .�.r�,� <br /> ; RESOLUTION OF THE CITY COUNCIL <br /> °'` ��Y} NO. 2131 <br /> • <br /> � <br /> � _ � � ; <br /> A RESOLUTION APPROVING <br /> COMPREHENSIVE PI,AN AML�NDMENT NO. 1 <br /> FILE #1058 <br /> WHEREAS, in June of 1980, the Council of the City of Orono <br /> (hereinafter the "City" ) adopted a Community Management Plan <br /> (hereinafter "C.M.P.") , an integral part of that plan provided that <br /> sewered areas of the City be included within the Metropolitan Urban <br /> Service Area (hereinafter "M.U.S.A. ) and Metropolitan Sewer Service <br /> Area (hereinafter "M.S.S.A.) ; and <br /> WHEREAS, the C.M.P. indentified five specific areas within <br /> � the rural zones of the City as requiring alternative waste management <br /> studies, three of these areas included the older, established Crystal <br /> Bay neighborhood, existing residential and commercial uses adjacent to <br /> Browns Bay and the Minnetonka Bluffs neighborhood; and <br />_ WHEREAS, in 1980 and 1981, the City approved extension of <br /> municipal sewer to the Browns Bay area (Exhibit A) and the Minnetonka <br /> • Bluffs neighborhood (Exhibit B) , and in 1985, ta the Crystal Bay <br /> neighborhood (Exhibit C) finding the only acceptable and/or feasible <br /> alternative for waste treatment in consideration of the options set <br /> , forth in C.M.P. 6-44 was to extend adjacent sewer lines; and <br /> WHEREAS, on December 8, 1986, the City approved Resolution <br /> 2097, a resolution granting approval of certain variances for D. Brian <br /> and Cathy L. Fulmer that would concurrently require amendment of the <br /> C.M.P. seeking private connection to an existing metropolitan sewer <br /> line that intersects their property (Exhibit D), Findings (4) & (5) of , <br /> that resolution considered the alternative waste treatment options <br /> available to the severely limited property finding connection to the <br /> adjacent metropolitan sewer line the only feasible solution for <br /> current and future waste treatment; and <br /> WH$REAS, on December 15, 1986, the City filed an amendment <br /> . with the Metropolitan Council that would allow the inclusion of the <br /> four areas defined above within the M.U.S.A. and the M.S.S.R. ; and <br /> WHEREAS, written notice was sent to surrounding local units <br /> of government and other affected jurisdictions requesting written <br /> comments by January 8, 1987, but no oral or written comments have been <br /> received by the City; and <br /> WHEREAS, on February 12, 1987 at a regularly scheduled <br /> � • meeting, the Metropolitan Council approved the Comprehensive Plan <br /> Amendment as proposed by the City. <br /> - Page 1 of 2 <br />
