� �� <br /> o � � <br /> '$���,.:- , C ITY of ORONO <br /> ,� � .�, :�, � <br /> �n?- � ti <br /> �' � � '�' RESOLUTION OF THE CITY COUNC�L <br /> �L�kES�I�4�G NO. rd-�Q-�--_ <br /> preserve a substantial property right of the applicants; and would be in <br /> keepin� with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLIISIONS, ORDER AND CONDITIO?�TS <br /> Based upon the above findings, the Orono City Council hereby �rauts variances to <br /> Orono Muilicipal Zonin� Code Sections 78-1279(1), 78-1279(6) and 78-1288 to allow <br /> construction of an addition, subject to the followin� conditions: <br /> 1. Council approval is based oil the site plan submitted by the applicants and <br /> annotated by City staff; attacl�ed to this Resolution as E�hibit A. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require further Plannin� Coirunission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall be reduced to 951 s.f. or 13 % (including steps <br /> to the lakej. Hardcover in the 75-25G' zone shall be limited to 6,2�6 s.f. or 3�% <br /> per the proposed plan and hardcover allowance summary attached to this <br /> Resolution as Exhibit B. Applicants are advised that aily future requests to <br /> increase hardcover or chan�e the nature of existing/approved hardcover shall <br /> require City appro�°al, and increases in hardcover will not liI`ely be approved <br /> without concurrent reduction in exisiin�hardcover. <br /> 3. Applicants shall remove a?1 plastic o: fabric liner material from the decorative <br /> landscape beds oz7 the property to ensure their pernleability as non-hardcover <br /> surfaces. <br /> �. Required reinovals of structure and hardcovei• sl�all be completed before the <br /> addition is occupied. <br /> 5. Authorities �ranted by this resolution run with tlle property not witl� the <br /> applicants, but are pennissive onlv and must be e�ercised by obtainin� a buildi�lQ <br /> permit for the new construction before September 11, 2007.
