 o
0 0
' - CITY of ORON4
'g;
  r
'/` G'' RESOLUTION OF THE CITY COUNCIL
kESH` NO. 5 7 9 g
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
 FINDINGS
. l. This application was reviewed as Zoning File #08-388.
2. The Property is located in the LR-1 C zoning district, where 0.5 acre is the
minimum lot area and 100 feet is the minimum lot width. The Property is
approaimately 0.3 acre (including wetlandj in area and 11.43 feet in width.
3. The Planning Commission reviewed this application on November 17, 2008
and on a vote of 4 - 2 recommended approval of the variances, based on the
following findings:
a. The presence of the lal:eshore along the side of the lot rather than opposite
the road is unusual and results in more of the property being within the 0 to
75 foot zone than is typical.
b. The property has only a single-car, tuckunder garae. Converting more of
the basement to Qarae is not feasible because of the need to raise the floor
of the araae and the entry room by 1.7 feet to comply with floodplain
regulations.
c. To locate the addition outside the buffer setback would require additional
hardcover.
4. The City Council has considered this application including the findings and
recominendation of the Planning Commission, reports b5 City staff, comments
by the applicants and the public. and the effect of the proposed variance on the
health, safety and welfare of the communit.
. The Cit Council finds that the conditions eaisting on this property are peculiar
to it and do not apply aenerally to other property in this zonin district; that
granting the variances would not adversely affect traffic conditions, liht, air
nor pose a fire hazard or other danger to neihboring property; would not
merely serve as a convenience to the Owners but are necessary to alleviate a
Page 2 of 5
