0 0 <br /> CITY of ORONO <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> SI304�G NO. _ 5 7 9 8 <br /> demonstrable hardship or difficulty; are necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to Orono <br /> Code Section 78-1288 to allow 28.5 percent hardcover within the 75 to 250 foot zone and a <br /> variance to Orono Code Section 78-1608(2) to allow a building within the 20 foot required <br /> setback from two wetlands, subject to the following conditions: <br /> 1. Council approval is based on the site and house addition plans submitted by <br /> the Owners and annotated by City staff, attached to this Resolution as Exhibits <br /> A and B. Any amendments to these plans may require further Planning <br /> Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall be limited to 216 s.f. or 1.9% for the existing <br /> deck and retaining walls. Hardcover in the 75-250' zone shall be limited to <br /> 3,295 s.f. or 28.5% per the proposed site plan and hardcover allowance <br /> summary as depicted on Exhibit C. The owners are advised that any future <br /> requests to increase hardcover or change the nature of existing/approved <br /> hardcover shall require City approval, and increases in hardcover will not <br /> likely be approved without concurrent reduction in existing hardcover. <br /> 3. Wetland buffers shall be improved per Exhibit D. <br /> 4. By separate document the Owners shall grant the City a Flowage and <br /> Conservation Easement and Restrictive Covenant for Wetland and Wetland <br /> Buffer over the wetland and wetland buffer areas on Exhibit D. <br /> 5. The Certificate of Occupancy shall not be issued until an as-built grading plan <br /> verifying compliance with engineering and zoning approvals has been <br /> submitted and approved. Any deviation from the approved plan may require <br /> Planning Commission and/or City Council review. <br /> 6. Owners shall remove and not replace any plastic or fabric liner material under <br /> Page 3 of 5 <br />
