� O� <br /> O 0 <br /> � ���g..- C ITY of ORONO <br /> ,� -. ,. � <br /> �� *� G�' RESOLUTION OF THE CITY COUNCIL <br /> L`�kEsKo�`'� No. 5 6 2 1 <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Sections 78-350 and 78-1279 to allow portions of <br /> additions to the existing home to encroach 5' into the 10' side setback and into the 75' lake <br /> setback; and overhangs of 2.0' on the entire house (except for the portion encroaching 5' into the <br /> side setback); and a variance to Orono Municipal Zoning Code Section 78-350 to allow the <br /> existing defined 3 story home to be remodeled so that it .will remain a 3 story house; and <br /> variances to Orono Municipal Zoning Code Section 78-1288 to allow 17.1% (3,773 s.f.) <br /> hardcover within the 0-75' zone where 16.1% (3,559 s.f.) currently exists and 0% is normally <br /> allowed; and 45.5% (1,689 s.£) within the 75' — 250' zone where 63.4% (2,351 s.£) currently <br /> exists and 25% is normally allowed in order to construct additions to the existing home, subject <br /> to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and annotated by <br /> City staff, attached to this Resolution as Exhibits A & B. Any amendments to the site <br /> plan which are not in conformity with City codes will require further Planning <br /> Corrunission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall not increase above the level of 3,773 s.f. or 17.1%. <br /> Hardcover in the 75-250' zone shall be limited to 1,689 s.f. or 45.5% per the proposed <br /> plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised <br /> that any future requests to increase hardcover or change the nature of existing/approved <br /> hardcover shall require City approval, and increases in hardcover will not likely be <br /> approved without concurrent reduction in existing hardcover. <br /> 3. While the home is proposed to have 2' roof overhangs; on the portion of the home which <br /> encroaches 5' into the required 10' side setback, the roof overhangs shall not exceed 18". <br /> 4. Applicants shall remove all plastic or fabric liner material from the decorative landscape <br /> beds on the property to ensure their perrneability as non-hardcover surfaces. <br /> 5. Required removals of structure and hardcover to be removed shall be completed prior to <br /> the footing inspection for the addition. <br /> 6. Authorities granted by this resolution run with the property not with the applicants, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> Pa�� 3 of 5 <br />
