� o� <br /> O �, O CITY of ORONO <br /> ���: <br /> �-1 � �---;�'''%,.,. � RESOLUTION OF�TH�Eo I�Y COUNCIL <br /> �.,._., <br /> �� y ::�` ti <br /> NO. <br /> G <br /> ��kEsHo�� <br /> J ��_ .;� : <br /> A RESOLUTION <br /> GRANTING A VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279(6) AND <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTION 78-966 <br /> FILE NO. 13-3604 <br /> WHEREAS, Neil Goodwin and Barbara Goodwin, a married couple <br /> (hereinafter "the Applicant") are the owners of the property located at 2975 Casco Point Road <br /> within the City of Orono (hereinafter the "City") and fegally described as: attached on Exhibit A <br /> (hereinafter the "Property"); and <br /> WHEREAS, the Applicant has made appfication to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of a new <br /> home ahead of the average lakeshore setback; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Code <br /> Section 78-966 to aliow grading for construction of new retaining walls and stair system in <br /> conjunction with removal of the existing retaini�g walls and stairs within the 75-foot setback on <br /> the Property; and <br /> WHEREAS, after due pubiished notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, public hearings were held by the <br /> Orono Planning Commission and City Council on June 17, and July 8, 2013 at which times all <br /> persons desiring to be heard concerning this application were given the opportunity to speak <br /> thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 13-3604. <br /> 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 0.5 acre and a minimum lot width of <br /> 100'. <br /> Page 1 of 5 <br />
