�, y • . . <br /> � � , Clt� o� ORONO { <br /> • � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2037 <br /> � � • • ' <br /> A RESOLIITION GRAAITING <br /> � A VARIANCE TO <br /> MONICIPAL ZONING CODE <br /> S$CTION 10.02, SDBDIVISION 65 <br /> FILE #1061 <br /> WH$R$AS, Larry and Lincla Cook (hereinafter "the applicants") <br /> are the owners of the property located at 3765 Watertown Road within <br /> the City of Orono {hereinafter "City") and legally described as <br /> � follows: <br /> The West 196.50 feet of the Southeast quarter of the Southwest <br /> quarter of Section 32, Township 118 North, Range 23 West of the <br /> 5th Principal Meridian, lying South of the centerline of <br /> Watertown Road (hereinafter "the property"); and <br /> WHERBAS, the applicant has applied to the City for a <br /> � variance to Municipal Zoning Code Section 10.02, Subdivision 65 to <br /> permit the construction of a horse barn located less than the required <br /> 150' setback distance from the side lot line. <br /> NOW, TH$REFORE, B$ IT R$S.OLVED by the City Counci 1 of Orono, <br /> Minnesotas , � <br /> - FINDINGS <br /> l. This application was reviewed as Zoning File #1061. <br /> 2. The property is located in the RR-lA Single Family Rural <br /> Residential Zoning District. <br /> � 3. The Orono Planning Commission reviewed this application on <br /> August 18, 1986, and recommended approval of the proposed <br /> variance subject to a 50' side setback rather than the 10' side � <br /> setback requested, finding that the proposed structure will be <br /> more than 150' froin any nearby residence buildings, also subject <br /> � to applicant providing written notice of non-objection from the � <br /> affected easterly neighbor. <br /> 4. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the <br /> • community. <br /> Page 1 of 3 <br />
