RESOLUTION OF THE CITY COUNCI L <br /> � NO. 2021 - <br /> . � . . <br /> � - � � .�.. • <br /> e City Council finds that the conditions ex`i�sting on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLIISIONS, ORDER AND COIaDITIONS <br /> Based upon ;the above findings, the Orono City Council hereby <br /> grants a variance to the Municipal Zoning Code Section 10.22, <br /> Subdivision 2 to permit the construction of a detached garage which <br /> wil 1 increase hardcover in the 75-250' lakeshore setback zone from the <br /> existing 32.9� or 2,977 s.f. to 3,124 s.f. or 34.5�, subject to the <br /> fol lowing conditions: <br /> 1. Adequate erosion protection shall be provided during the <br /> • grading and construction process. <br /> 2. The three existing sheds in the rear yard shall be removed. <br /> The shed at the lakeshore may remain but is considered a non- <br /> conforming structure and is subject to the pertinent ordinances <br /> governing such structures. <br /> 3. The proposed 35'x25' garage shall be located as shown on the <br /> proposed plan on file at the City office. <br /> 4. A grading permit and bui lding permit must be obtained prior <br /> to construction. <br /> � 5. The maximum hardcover on the property shall be as follows: <br /> 0-75 ' setback zone - 196 s.f. or 5.8� . <br /> 75-250 ' setback zone - 3,124 s.f. or 34.5$ <br /> The applicant is advised that no additional hardcover above these <br /> limits will be approved, and any future proposals for additional <br /> hardcover might be approved only with concurrent removals of <br /> existing hardcover. <br /> 6. Authorities granted by this variance run with the property <br /> not with the a�pplicant, but are permissive only and must be <br /> • exercised by application for a building permit within one year of <br /> the date of Council approval, or this variance will expire on <br /> that date (July 14, 1987). <br /> Page 2 of 4 <br /> , <br />
