Staff believes the width of the lift and dock should not exceed 10'. Is it appropriate to <br /> grant a side setback variance for a site that was created after the February 2, 1970"grandfathered" 5' <br /> setback date?The Board should determine what the hardships are. <br /> 3. What is the appropriate number and size of the restrictetl watercraft to be stored at this site? <br /> It seems that one restricted watercraft is reasonable for a site of this size with the Board to determine <br /> the size. <br /> S#aff believes that the witlth of the proposed dock and lift is excessive for a lot that was created in 1978 <br /> with 20'of shoreline. If the Board is inclined to act upon this variance application immediately, Staff <br /> recommends that the Board direct LMCD legal counsel to prepare Findings of Fact and Order to deny the <br /> side setback request and to approve the dock length variance. In this case, the only way that this site would <br /> have a dock use area would be if one or both adjoining property owners, by mutual agreement, would <br /> adjust the side setback requirements. <br /> Staff recommends that the Board table or continue this agenda item to a subsequent meeting and direct <br /> staff to work with the applicant to amend their application and site plan to meet the direction of the Board <br /> based off of the information collected during the public hearing addressing the funtlamental issues outlined <br /> above. <br />
