Upon the Planning Commission's recommendation, the City Council of Orono passed <br /> Resolutions in September 1977 and in January 1978 granting variances to <br /> accommodate the formal subdivision of the Moran property creating separate individual <br /> homesites at 2965 and 2967 Casco Point Road, including "variances for structures and <br /> dock". The variances were granted and park dedication fees were waived in recognition <br /> of the fact that the homes had existed for many years and that the homeowner had <br /> cooperated with City efforts to resolve longstanding right-of-way issues. <br /> The Applicant has submitted Orono City Council and Planning Commission Minutes as <br /> well as the Neighborhood Homeowners' Petition showing the consent and approval of <br /> all homeowners in the immediate area, including specifically homeowners on either side <br /> of the riparian shoreline then owned by Hamilton and Charlotte Moran. All neighboring <br /> homeowners received Notice of the Public Hearing at which Hamilton Moran explained <br /> that he had the consent of his adjoining riparian neighbors to waive dock setbacks so he <br /> could maintain the riparian dock on 2965 Casco Point Road. <br /> Application Request: <br /> 1. Dock Length variance to four feet of water at OHW 929.4; <br /> 2. Side Setback variance from north extended property line of five feet <br /> (minimum); <br /> 3. Right to keep a boat lift to be entered from the west without a canopy; <br /> 4. Dock Use Area of up to twelve feet of width w/o encroachment of extended <br /> south property line, except with consent of adjacent property owner to the <br /> south. Variance to allow boat lift to encroach over extended south property <br /> line using up to a twelve foot width of Dock Use Area with the consent of <br /> adjoining neighbor to the south; <br /> 5.
