Although the requesi for variance is excessivc, due primarily to ihe size of the boai lifi <br /> proposed, and placing that boat lift on the side of the proposed dock,thc Board finds that granting a <br /> lesser variar�ce is reasonable as an accommodation to ihe hardship existing at ihis site. <br /> ORDER <br /> ON THE BASIS OF THE FOREGOING, IT IS ORDERED: <br /> 1. Tlie requested lengih varia�ice to allow construction of a dock out to 56 feet from ihe <br /> shoreline ai elevation 929.4 NGVD is granted. <br /> 2. The application for a side setback variance is denied in pa�-1 and gra�Ited in part as <br /> follows: <br /> a. To the extent that the requested dock use area exceeds that gra.nted in this <br /> Order,the side sefiback application is denied. <br /> b. Side setback variances are granted sufficient to provide a 10-foot wide dock <br /> use area extended from the shoreline 56 feet into the Lake from elevation <br /> 929.4 NGVD, with the northerly line of such 10-foot dock use area being <br /> parallel to and f ve feet south of the northerly extended lot line of the site. <br /> 3. The variances granted by tlus Order are subject to fl1e following conditions: <br /> a. All docks, boat lifts and related structure and watercraft storage must be <br /> maintained within the dock use area. <br /> b. Only one restricted watercraft, as that teim is defined in LMCD Code of <br /> Ordinances,may be stored or moored at the site. <br /> c. The dock must be a straight dock,with no "L"or"T",unless such"L"or"T" <br /> is located east of the boat lift or ofl�er watercraft storage at the dock facility. <br /> d. The landowner shall construct a�id maintain witness monuments, installed by <br /> a licensed surveyor, delineating lines parallel to and 5 feet south of the <br /> northerly extended lot line of the site and parallel to a�7d 15 feet south of the <br /> northerly extended lot 1'uie of the site, which will show the side lines of the <br /> dock use area approved by this Order. <br /> e. The Applicants shall provide proof to the LMCD that a copy of this Order <br /> has been reeorded against the title to the subject parcel with Hemlepin <br /> Coiuity. <br /> 325478v1 CLLLK110-4 2 <br />
