Box 66 <br /> Orono, MN 55356 Crystal Bay, MN 55323-0066 <br /> June 6, 1994 <br /> Mr. Pat Wolfe <br /> 2871 Casco Point Road <br /> Wayzata, Minnesota 55391 <br /> Re: Storage Shed <br /> Dear Mr. Wolfe: <br /> Pursuant to our discussion of May 31, I understand you will not be providing the City with a <br /> revised survey showing your new storage shed as being within your property boundaries. <br /> Consequently, your after-the-fact variance application has not been scheduled for the June <br /> Planning Commission meeting. <br /> You indicate it is now your position that the storage shed is actually an "ice fishing house" <br /> which you intend to move out onto the ice each winter and store temporarily on the shore in the <br /> summer. I acivised you I would review the City codes regarding the status of "fish houses". <br /> As a "shed", your building is considered as a permanent structure; as a "fish house", it is <br /> considered as a temporary structure. Both permanent and temporary structures are dealt with <br /> similarly in Section 10.55, Subd. 8 and Section 10.22, Subd. 2. Neither temporary nor <br /> permanent structures are allowed within 75' of the lake nar encroachin� past the averaae setback <br /> line. Neither you nor any other resident are allowed to store a "fish house" in the lakeshore <br /> yard not meeting the setback requirements. A temporary structure is considered hardcover, is <br /> an encroachment, and is regulated the same as a permanent structure. <br /> Your comment that many property owners on Casco Point have fish houses stored next to the <br /> lake has no bearing on your individual situation. Furthermore, our shoreline inspection tour of <br /> the Casco Point, West Arm, Forest Lake, North Arm and Carman's Bay areas on June 2nd <br /> found no more than five "fish houses" on approximately 14 miles of shoreline. They simply are <br /> not being stored on the shoreline at the vast majority of lakeshore residences. <br /> The City's position on your building has not changed and will not change no matter what you <br /> call it. Further, the City has no survey that shows this building is located or stored within your <br /> property boundaries.
