Sec.13.04 RICHTSOFSUBJECTSOFDATA <br /> Subdrvrsion 1. Type oJdata The rrghts of individua[on whoin the data is stored or to be stored shal!be as set forth in thrs sectron. <br /> Subd.1. Injormation required to be given individuaL An individual asked!o supply private or confidentral data concerning hrmself <br /> shall be informed of.• (aJ the purpose and intended use of the requested data within the collecting state agency,political subdrvrsion,or statetivrde <br /> system;(b)whether he may refuse or is legally required to supply the requested data;(c)any knotivn consequence arrsing from his supplyrng or <br /> refusing to supply prrvate or confidential data;and(d)the identity of other persons or enttties authorized by state or federa!lmv to receive the data. <br /> This requirement shall not apply when an individual is asked to supply investigative data,pursuant to section 13.82, subdivision S, to a lmv <br /> enforcement o�cer. <br /> The commissioner orrevenue mav place the notice required under this subdivisron in fhe individual income tax or property tax rejund <br /> instructions instead of on those forms. <br /> Subd.3. Access to data by individuaL Upon request to a responsrble authority,an individual shal!be injormed whefher he is the subject <br /> of stored dala on rndividuals, and whether it is classified as public,private or confidential. Upon his jurther request,an indivrdua!who is the <br /> subject of stored private or public data on individuals shall be shotivn the data ivithout any charge to hrm and,if he desires,shall be informed of <br /> the content and meaning o,f'that data. After an rndividual has been shotivn the private data and informed ojits meaning, the data need not be <br /> drsclosed to him for six months thereafter unless a dispute or action pursuant to this sectian rs pendrng or addifional data on the rndividual has <br /> been collected or created. The responsible authority shall provrde copies oJthe private or public data upon request by the rndrvidual subject oJ <br /> the dala. The responsible authoriry may require the requesting person to pay the actual costs of makrng,cert�ing,and compiling the capres. <br /> The responsible authorrry shal!comply immediately,rfpossible,with any request made pursuant to this subdivision,or tivithin frve days <br /> of the date of the request,excludrng Saturdays,Sundays and legal holydays,rjrmmediate compliance is not possibfe. Ijhe cannot comply ivith the <br /> request ivithin lhat time,he shal!so inform fhe individual,and may have an additronal ftve days tivithrn which to comply with the requesl,excluding <br /> Saturdays,Sundays and legal holidays. <br /> Subd.4. Procedure when data is not accurate or complete.An individua!may contest the accuracy or completeness ofpublic or private <br /> data concerning himself. To exercise this right, an indivrdual sha11 not�in writing the responsible authority describing the nalure of the <br /> disagreement. The responsible authority shall�vithrn 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to notify <br /> past reciprents of rnaccurate or incomplete data,including recrprents named by the individual;or(b)notify the individual that he believes the data <br /> to be correct. Data in dispute shal/be disclosed only if the rndividual's stalement of disagreement is included with the disclosed data. <br /> The determination oJthe responsible authority may be appealed pursuant to the provisrons ojthe administrative procedure act relating <br /> to contested cases. <br /> DATA PRIVACYADvlSORY <br /> In accordance with M.S./3.04,Subd.2, "Rights of subjects of data",we would like to inform you that your request for a permit or license <br /> from the City of Orono or any of its departments may require you to jurnish certain private or confrdential information. <br /> You are notified that: <br /> 1.
