The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variances would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other dan�er to neighboring <br /> property; would not merel}�serve as a convenience to tl�e applicants, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicailts; and would be in <br /> lceepin� �vith the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCL�JSI0I�TS, O�EI2 ANI� COl�DI'I'IONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> �-ants variances to Orono Municipal Zoning Code Sections 7�-350 (B) and 78-1279 (6) <br /> to allow constniction of a 12/12 pitch roof where a 4/10 pitch roof currently exists, whiclZ <br /> will iilcrease the ceiling height in the main level lcitchen/living area and add a Yz story <br /> over the existin� garage and inain level bedrooms requiring a rear yard setbacic variance <br /> to pemlit a rear yard setbacl: of 20' when 30' is nornlally required, 20' cun-ently e�ists, <br /> and 20' was permitted by variances in 1968 and 1999 and to pei�nit a covered entry <br /> setbacl: 15' froin the rear lot line where 30' is noi-mally required and 20' currently exists, <br /> subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants and <br /> annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendments to t}.Ze site plan �vhich are not in confornlity with City codes will <br /> require fiiz�tl�er Planning Commission and City Council review. <br /> 2. The covered entry shall remain unenclosed. IF at any time the applicants submit <br /> for a building pei-mit to enclose the covered entry, a variance to the rear yard <br /> setbacl:requiremellC would be rec�uire�d. <br /> 3.
