1 <br /> �a <br /> . i <br /> y,S. w <br /> � C�t� o� ORONO <br /> • RESOLUTION OF THE CITY COUNCIL <br /> • ;sF NO. 1883 <br /> � • • • <br /> . <br /> A RESOLOTION GRANTING <br /> A CONDTIONAL DSE PERMIT <br /> PER MUNICIPAL ZONING CODE <br /> SECTION 10.20, SIIBDIVISION 3 (R) <br /> FILE #976 <br /> WHER$AS, Calvin Charles Korth (hereinafter -"the applicant") has <br /> an interest in the property located at 3615 Lyric Avenue within the City of <br /> Orono (hereinafter "City" ) and legally described as Lot 10, B3.ock 3, <br /> Navarro (hereinafter "property"); and <br /> WHEREAS, the applicant has applied to the City of Orono for a <br /> Conditional Use Permit to keep a pigmy goat within his residence per <br /> Municipal Zoning Code Sectionf10.20, Subdivision 3 (K). <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council. of Orono, <br /> Minnesota: <br /> , <br /> FINDINGS <br /> • l. This application was reviewed as Zoning File #976. <br /> 2. The property is located in the LR-1C-1 Lakeshore Sub-District. <br /> 3. On October 21, 1985, the Orono Planning Commission reviewed the <br /> application as proposed and recommended approval based on the <br /> following findings: <br /> A) The goat is maintained as a house pet and not as a farm <br /> animal. The goat is maintained within applicant's residence. <br /> B) Area requirements per Section 10.20, Subdivision 3 (K) are <br /> . not applicable as goat is kept within residence and goat does not <br /> require grazing area for food. <br /> C) Surrounding neighbors and most affected neighbors have aIl <br /> submitted written statements approving the keeping of the goat as <br /> proposed by applicant. <br /> . D) Dr. Bailee of the Cedar Pet Clinic and Dr. Bill DeBold, of <br /> the University of Minnesota 's Large Animal Clinic, confirm that <br /> the pet goat does not require special vaccinations or innocula- <br /> tions. The keeping of the goat will create no potential health <br /> threats for neighborhood or surrounding community. <br /> S4. The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> staff and the oral and written comments of the applicant and the <br /> effect of the proposed use on the health, safety and welfare of the <br /> community. <br /> Page l of 3 <br />
