Applicant is placed on notice that Orono Municipal Zoning <br /> ` Code Section 10.03, Subdivision 6 (C) prohibits the sale or <br /> � transfer of any parcel or combination of adjacent parcels which <br /> singly or in combination are non-conforming in area or width; or <br /> � . which sale or transfer makes the retained property or properties <br /> rv non-conforming; without Council approval. <br /> t <br /> � 4. Applicant is further placed on notice, that based on the � <br /> survey submitted with the application, the existing main house at <br /> ; one point appears to be only 23' from the side lot Iine where a <br /> ;; 30' side setback is required, hence sale of the guest house <br /> �� parcel would cause the main house parcel to be non-conforming, in <br /> Q violation of §10.03, Subdivision 6 (C). A simpl.e lot line re- <br /> <� arrangement would remedy this potential future problem. Al.so, <br /> �� the survey indicates that the Iot lines could be arranged so that <br /> - while maintaining a 30' setback to the existing house, the Iot <br /> width of the guest house parcel coul.d be increased to approxi- <br /> , mateI.y 195', nearl.y meeting the required Iot width but still. <br /> . requiring a slight variance. <br /> � 5. Applicant is further placed on notice that if the guest house <br /> parcel was sold off separately, that an access easement would be <br /> required over the existing driveway on the main house property. <br /> : 6. The applicant is advised to check on the relative property <br /> ' tax benefits of combining or not combining the 9 properties held <br /> in common. <br /> � 7. Violation of or non-compliance with any of the terms and <br /> conditions of this resol.ution shall. constitute a violation of the <br /> . Zoning Code, shal 1 automaticall.y terminate any authority granted <br /> herein, and shall be punishable as a misdemeanor. <br /> 8.
