The property is located in the RR-1B Single Family <br /> Rural Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application <br />� on September 16, 1985, and recommended approval of the <br /> proposed variance based upon the following findings: <br /> A) The applicant is Iegal ly operating this golf course � <br /> under a Conditional Use Permit granted September 9, <br /> 1968. <br /> B ) The Municipal Zoning Code allows accessory <br /> structures as part of a Conditional Use Permit as Iong <br /> as such structures are at least 50' from aIl property <br /> lines. Applicant has stated the proposed structure <br /> � will be Iocated to meet this setback. <br /> C) The structure is proposed to be used for storage of <br /> golf course materials and equipment. <br /> • 4. The area of the property is in excess of 120 acres. <br /> 5 . The City Council has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by City staff, comments by the appl.icant <br /> and the effect of the proposed variance on the health, <br /> safety and welfare of the community. <br /> 6. The City Counci I f inds that the conditions exi sting on <br /> this property are peculiar to it and do not apply generally <br /> to other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions, <br /> Iight, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to aI Ieviate <br /> a demonstrable hardship or difficulty; is necessary to pre- <br /> serve a substantial property right of the applicant; and <br /> woul.d be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLOSIONS, ORDffi2 AND CONDITIONS <br /> Based upon the above findings, the Orono City Council <br /> hereby grants a variance to the Municipal Zoning Code Section <br /> • 10.03 , Subdivision 9 (C ) to permit the construction of an <br /> accessory storage structure comprising a total of 2240 square <br /> feet of floor area (two f Ioors at 1120 square feet each) where a <br /> maximum floor area of 1000 square feet is normally required, <br /> subject to the following conditions: <br /> Page 2 of 4 <br />
