�� ..�. <br /> � <br /> !� <br /> . d C�ty o� ORONO <br /> � RESOLUTION OF THE CITY COUNCIL . <br /> � NO. 1842 <br /> • � • • <br /> • A RESOLDTION ORDERING ABATEMENT OF <br /> (HAZARDODS BOILDING ACTION AT <br /> � ! 2695 CASCO POINT ROAD <br /> WHEREAS, the City of nrono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WHEREAS, Ron Noland 4651 Nicols, Egan, Minnesota 55122 <br /> the fee owner of record of property; and <br /> WHEREAS, Builders Finance, 1055 Wayzata Boulevard, ' <br /> Wayzata, Minnesota 55391 and Chuck & Sheri Ost, 8035 Erie Avenue, , <br /> Chanhassen, Minnesota 55317 have an interest in the property <br /> located at 2695 Casco Point Road, Orono, Minnesota, herein <br /> referred to as "property" and legally described as follows: <br /> • Auditors Subdivision No. 265 <br /> P.I.D. : 20-117-23 23 0003 <br />� WHEREAS, the City Council of the Gity of Orono, having <br /> duI.y considered the matter pursuant to Minnesota Statutes <br /> Sections 463.25 to 463.251, hereby finds that the above described <br /> property is unhabitable and contains hazardous conditions which <br /> constitute a public nuisance and which makes this property <br /> hazardous to the pub�I.ic health, safety and welfare based on the <br /> following findings: <br /> • l. Building open to public. � � <br /> 2. Building has not been backfill.ed - excavation around <br /> building and in garage (attached) 8 '+ deep. <br /> 3. Orders to correct these hazardous conditions were issued <br /> by the Building Offical on 7/5/85 and 8/16/85. These orders <br /> have not been complied with. <br /> NOW, THEREFORE, BE IT RESOLVED as follows: <br /> l. That the City Council of the City of Orono, .pursuant to <br /> the foregoing findings and in accordance with Minnesota <br /> Statutes Sections 463.25 to 463.251 hereby orders the <br /> � owner(s) of the subject property to correct on the property <br /> these hazardous conditions within the time as follows: <br /> ' a) Building boarded up - 10 days. <br /> b) Hazardous excavation - 15 days. <br /> � Page 1 of 2 <br />
