The Orono Planning Commission reviewed this application on August 18, 1997, <br /> and recommended unanimous approval of the proposed variance based upon the <br /> following unique findings and hardships: <br /> A. The subject property. does not meet the minimum lot area or lot width <br /> requirements. <br /> B. The topography in the 0-75' setback from the lakeshore is steep. The <br /> hardcover in the west side yard is needed to redirect water away from the <br /> existing residence. <br /> C. The bay window will be located over existing rock in the side yard. <br /> 4. The City Council finds that the conditions existing on this property are peculiaz <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, lioht, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping �vith the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a hardcover variance to install a 10'9"x4' bay window over existing rock per Municipal <br /> Zoninj Code Section 10.22, Subdivision 2 to permit 6,417 sq. ft. or 59.65% in the 75-250' <br /> setback where 6,460 sq. ft. (60.0�%) is existing and 2,689.25 sq. ft. (25%) is allowed, subject <br /> to the following conditions: <br /> Page 2 of 5 <br />
