NO. 1806 <br /> • `�F .�;. , <br /> :�: <br /> ,,� <br /> e - • � : <br /> _�,;,�>�,;::: � � , <br /> �C��'�'�� . . . <br /> A RESOLDTION DETERMINING THAT SANITARY <br /> SEWER SERVICE WILL NOT BE PROVIDED TO THE <br /> VACANT PROPERTY FRONTING ON CRYSTAL AVENDE <br /> RNOWN AS PID #10-117-23 31 0015 <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, Sewer Project 85-1 was initiated by the City to <br /> solve existing on-site sewage treatment problems in the Crystal Bay <br /> area, within which PID #10-117-23 31 0015 is located; and <br /> WHEREAS; the aforementioned PID #10-117-23 31 0015 is <br /> • � legally described as follows: <br /> The East 18.5 feet of the West 511 feet of the North 66 feet of <br /> � the South 703.925 feet of the Northeast quarter of the <br /> Southwest quarter of Section lQ, Township i17 North, Range 23 <br /> West, Hennepin County, Minnesota; and <br /> . WHEREAS, said property is in single separate ownership and is <br /> � owned in commori with PID #10-117-23 31 0035 located at 1295 Arbor <br /> Street, which tiao properties are separated by the platted right of way <br /> � of Crystal Avenue; and <br /> WHEREAS, PID #10-117-23 31 0015 contains a garage but no <br /> principal structure; and <br /> , � - <br /> WHEREAS, the total area of PID #10-117-23 31 0015 is 1,221 <br /> square feet or 0.03 acres, as compared to the existing zoning <br /> ' regulations requiring 2.0 acres per buildable �site; and <br /> � WHEREAS, PIII #10-117-23 31 0015 is nbt considered buildable <br /> , : , without numerous variances from the existing zoning code; and <br /> WHEREAS, construction of a single family residence on PID <br /> . #10-117-23 31 0015 would be contrary to the intent of the Community <br /> - Management Plan; and - <br /> � , _ WHEREAS, the property owner taould not be denied a substantial <br /> property right� if sewer is not provided to PID #10-117-23 31 0015. <br /> \ � <br /> �, <br /> Page 1 of 2 <br />
