Based on the telephone conversation you and I had following my inspection, I <br /> understand that there may be some additional area of failure which extends onto the Frommelt's property <br /> at 2805 Casco Point Road. For this reason, I have copied the Frommelts on this letter. <br /> In order to help to prevent further damage, the slope should be protected as soon as feasible with an <br /> anchored tarp and silt fencing at and/or in the lake. Any material that has entered the lake should be <br /> removed as required by the Minnehaha Creek Watershed District (MCWD). We recommend you should <br /> hire a civil engineer to devise a restoration plan, which must be submitted to the City of Orono for <br /> engineering approval. <br /> Before that plan is developed, I think it would be helpful to have a meeting on your property to discuss <br /> the slope restoration process which should involve all parties which includes at a minimum, you (and the <br /> Frommelts), your contractor for restoration, your civil engineer, a representative from the MCWD, the <br /> City's engineer and myself. The slope should be restored to its previous condition and re-vegetated as <br /> soon as feasible. Once the plan is approved, you should implement that plan as soon as possible. <br /> City Code requires a City Council-approved Conditional Use Permit (CUP) for work within 75-feet of the <br /> lake. The CUP process technically requires a public hearing be held by the Planning Commission and a <br /> proper timeline of public notification given. Due to the sensitive nature of this incident we intend work <br /> with you to expedite the proper approvals through the City Council and permits, and we understand that <br /> MCWD will do the same. <br /> The following requirements can be discussed in greater detail during the site meeting, but I wanted to <br /> provide you an overview in writing with this letter. Once you have a restoration plan designed, please <br /> complete the enclosed Conditional Use Permit and Zoning Permit for Land Alteration applications <br /> to begin the process. A CUP application requires submittal of a $700 application fee. The permit escrow <br /> will be determined by the City's engineer based on the amount of disturbance/work to be conducted. <br /> You will see in the CUP application packet that a certified property owners list for the properties <br /> within 350'of the affected properties (2805 and 2807 Casco Point Road) is required to be submitted for <br /> proper notification. This list should be obtained from Hennepin County. <br /> A survey of the site should be submitted which meets the enclosed survey standards and reflects the <br /> existing conditions (i.e. shows the failures) and also reflects the proposed repair. A siqned" <br /> engineered plan for the slope repair, and a landscape plan resulting in a natural, vegetated <br /> appearance from the lake should also be submitted. <br />
