Rule F - Shoreline Improvement specified that no person shall construct a shoreline <br /> improvement to prevent erosion such as rip rap or retaining wall without first securing a permit <br /> from the District. As specified in the earlier letter, you are required to apply for an "after the fact" <br /> permit from the District for this project. <br /> To date we have not received a permit application and supporting exhibits as specified. Please note <br /> that District enforcement options to ensure compliance with the rules as outlined in Rule H as <br /> follows: <br /> 1. Violation of ftules a Misdemeanor. Violations of these rules, a stipulation agreement <br /> made, or permit issued by the Board of Managers pursuant to these rules, is a misdemeanor <br /> subject to a penalty as provided by law. <br /> 2. District Court Action. The District may exercise all powers conferred upon it by Minnesota <br /> Statutes Chapter 112 in enforcing the rules adopted hereunder including criminal <br /> prosecution, injunction or action to compel conformance, restoration or abatement. <br /> 3. Administrative Order. The District may issue a cease and desist order when it finds that a <br /> proposed or initiated project presents a serious threat to soil erosion, sedimentation� or an <br /> adverse effect upon water quality or violates any rule of the District. <br /> In addition, Rule J of the District rules specifies that District may recover the District costs of field <br /> inspection of the work including investigation of the area affected by the work, analysis of the <br /> work, and any subsequent monitoring of the work in the case of a violation. <br />
