This inspection revealed that a boulder wall has been constructed
along your shoreline without a permit from the Minnehaha Creek Watershed District.
Enclosed please find a copy of the District rules and a permit application form. Please note that
Rule F - Shoreline Improvements, specifies that no person shall construct a shoreline
improvement to prevent erosion such as rip-rap or retaining wall, or for any other purpose such as
boat ramps or sand blankets without first securing a permit from the District. Accordingly, you
are hereby notified that you are in violation of District Rules and are required to apply for an
"After-the-fact" permit from the District.
A completed permit application and supporting exnibits demonstrating conformance with District
standards must be submitted to the District. The required exhibits are outlined in Rule F -
Shoreline Improvements. In addition, if any fill was placed during performance of this project,
Rule C - Floodplain Alteration, may also apply. This matter will be reviewed by a committee of the
Board of Managers on Friday, October 12, 1990.
Please note further that under Rule J of the District Rules, any person who performs any work for
which a permit is required under these Rules without rst having obtained a permit from the
District, shall pay to the District a fee equal to the District's cost of field inspection of the work,
including investigation of the area af'f'ected by the work, analysis of the work and any subsequent
monitoring of the work.
