Based on the telephone conversation you and I had following my inspection,I ! <br /> understand that there may be some additionai area of failure which extends ontn the Frommelfis property <br /> at 2805 Casco Point Road. For this reason, I have wpied the Frommelts on this let�er. <br /> In order to help to prevent further damage, the siope should be protected as soon as feaslble w(th an <br /> anchored tarp and silt fencing at and/or in the lake. Any material that has entered the lake should be <br /> removed as required by the Minnehaha Creek Wa�ershed Distr(ct(MCWD). We recommend you should <br /> hire a ctvll engineer to devise a restoration pian, which must be submitted to the City of Orono for ' <br /> engineering approval. � <br /> Before that plan is developed, I think it would be helpful to have a meeting on your property to discuss <br /> the slape restoration process which should involve all parties whlch includes at a minimum, you (and the <br /> Frommelts), your contractor for restoration,your civil engineer, a representative from the MCWD,the <br /> City's engineer and myself. The slope should be restored to its previous conditfon and re-vegetated as <br /> soon as feasible. Once the plan is approved,you should impfement that plan as soon as possible. � <br /> City Code requires a City Council-approved Conditional Use Permit{CUP)for work within 75-feet of the � <br /> lake. The CUP process technically requires a public hearing be held by the Planning Commission and a � <br /> proper timeiine of public notification given. Due to the sensitive nattire of this incident we intend work <br /> with you to expedite the proper approvals through the City Councll and permits,and we understand that <br /> MCWD will do the same. <br /> The following requirements can be discussed in greater detail during the site meeting, but I wanted to <br /> provide you an overview in writing wlth this letter. Once you have a restoratfon plan designed, please <br /> complete the enclosed Conditionai Use Permit and Zoning Permit for Land Alberation applicatlons ; <br /> to begin the process, A CUP application requlres submittal of a $700 applicatlon fee. `fhe permit escrow ! <br /> will be determ(ned by the Clty's engineer based on the amount of disturbance/work to be conducted. <br /> You will see in the CUP applicatfon packet that a certlfled property owners list for the properties <br /> within 350'of the affected propertles(2805 and 2807 Casco Point Road) Is required to be submitted for <br /> proper notification. This list should be obtained from Hennepin County. <br /> A survey of the site should be submltted which meets the enclosed survey standards and reflects the <br /> existing conditlons (i.e. shows the failures)and also reflects the proposed repair.
