A VARIANCE TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.22, SDBDIVISION l <br /> � FILE #908 y <br /> WHEREAS:, Jon Scherven (hereinafter "the �applicant") has <br /> an interest in the property located at 2649 Casco Point Road <br /> within the City of Orono (hereinafter "City") and legally <br /> described as follows: <br /> Lo't 138, Spring Park (hereinafter "property" ) ; and <br /> WHEREAS, the applicant has applied to the City for a <br /> • variance to Muni.cipal Zoning Code Section 10.22, Subdivision 1 to <br /> permit the constra�ction of an addition to �his existing house, <br /> which addition wi11 encroach 8 feet into the required average <br /> �lakeshore setback area. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of <br /> Orono, Minnesota: • � <br /> FINDINGS . <br /> l. This appl;ication was reviewed as Zoning File #908. <br /> � <br /> 2. The property is located in the� LR-1C Single Family <br /> Lakeshore Residential Zoning District. <br /> � 3. The Orono Planning Commission reviewed this application <br /> on Apri 1 15., 19 8 5, and recommended approva 1 of the proposed , <br /> variances based upon the following findings: <br /> A) Applicant has agreed to remove 190 square feet of <br /> hardcover in the 75'-250' setback zone, which is an <br /> equival�e�t amount of hardcover to the portions of deck <br /> proposed in the 75'-250' setback zone. - �� <br /> B) The proposed addition will be placed over an area <br /> of existang hardcover in the 75'-250' setback zone. <br /> � C) Ther�e will be no net increase of hardcover in the ' <br /> 75'-250' setback zone.
