NO. 17 7 0 � <br /> � _ . <br /> • � • • � <br /> RE$OLUTION EOR INDEMNICATION OF ORONO POLICE OFFICER <br /> � RORT ERICRSON � <br /> WHEREAS, the City of Orono and its Pol ice Off icer Kurt <br /> Erickson have been named as defendents in a suit arising out of <br /> an accident that occurred on November 2P1, 1984, involving the son <br /> of the plaintiffs, Craig L. Quiggle; and <br /> ; . <br /> WHEREAS, the su�t requests in addition to in excess of <br /> $501,000 actual damages requests punitive damages against ��the <br /> individual officer; and � � <br /> • WHEREAS, the irisurance policy between the City and its <br /> insurer covering both the City and the individual specifically <br /> excludes payment for punitive damages; and <br /> WHEREAS , the City of Orono has the authority under <br /> Minnesota Statute 466.P17 to indemnify its employees; and � <br /> WHEREAS, the facts as known by the City and its leqal <br /> counci 1 at this time do not provide any basis for punitive <br /> damages. •• � <br /> NOW, THEREFORE BE IT RESOLVED, by the City Counci 1, the <br /> City of Orono hereby indemnfies its Police Officer Kurt Erickson <br /> � for any punitive damages arising out of the subject case based on <br /> the facts as presently� known to the extent permitted by • MSA <br /> 466 and relevant case law only to the extent such damages are not <br /> paid for by insurance carriers. <br /> Adopted by the City Council of the City of Orono, <br />; Minnesota at a regular meeting held May 28, 1985. <br />. � � ��� � <br /> Mary C. t er, Mayor <br /> � ATTE ' T: <br /> 0 ot y M. in, City C er <br />
