No average lakeshore view setback problem would be <br /> encountered. <br /> 5. Applicant has not yet completed the retaining wall <br /> modifications required per Resolution #1600. , <br /> 6 . The City Council has considered this application <br /> . including the findings and recommendations of the Planning . <br /> � Commission, reports by City staff, comments by the appli- <br /> cant, and the effect of the proposed variance on the health, <br /> safety, and welfare of the community. � <br /> • 7. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply generally <br /> to other prop^rty in this zoning district; that granting the <br /> variance woLld not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to neigh- <br /> boring property; would not merely serve as a convenience to <br /> the applicant, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a sub- <br /> stantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and <br /> , Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon the above f indings, the Orono City Counci 1 <br /> hereby .qrants a variance to Municipal Code Sections 10.55, Sub- <br /> division 8, and Section 10.22, Subdivision 2 to permit con- <br /> struction of home addition at 1545 Long Lake Boulevard which will <br /> extend 5 feet into the 0-75 foot setback zone where no structures <br /> . are normally allowed, and will increase hardcover in the 0-75 <br /> foot lakeshore setback zone to 3.3$ where 0� is normally allowed, <br /> and increase hardcover in the 75-250 foot lakeshore setback zone <br /> to 39.7� where only 25$ hardcover is normally allowed, subject to <br /> the following conditions: . <br /> � l. The applicant and future owners of the property are <br /> . advised that no suitable alternate septic system drainfield <br /> site exists for replacement of the existing drainfield. The <br /> existing septic system was constructed in 1984 and meets <br /> code standards for a 5-person household. If water use <br /> exceeds the designed absorption capability of the drainfield <br /> . system and failure occurs, a holding tank would be the most , <br /> likely sewage treat�nage �otter4native. <br />
