The Orono Planning Commission reviewed this application <br /> � on February 19 , 1985, and recommended approval of the <br /> proposed variances and conditional use permit, subject to <br /> City Engineer' s review and approval of the grading and <br /> drainage plans, based on the following findings : <br /> a) The existing home is setback 40 feet from the <br /> lakeshore. Applicant proposesto remove this home and <br /> construct a new home setback 60 feet f`rom the lakeshore. <br /> b) The home and boathouse currently existing on the <br /> property comprise 11� hardcover in the 0-75 ' setback ' <br /> zone. The proposed new home, boathouse, and steps <br /> would reduce the 0-75 ' hardcover to 6$. <br /> c) The existing steep topography and the locations of <br /> existing trees limit other sites for house placement. <br /> • d) The proposed house is a walkout which will require <br /> the removal of fill and major regrading of the lakeshore <br /> � banks located within 75 feet of the lakeshore. <br /> 4. The City Engineer has reviewed the grading and drainage <br /> plan and has recommended approval with minor change� which <br /> will tend to decrease the rate of runoff and increase <br /> infiltration in the lakeshore yard area. <br /> 5. The City Council has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by staff and comments of the applicant <br /> and the effect of the proposed land alteration and variances <br /> on the health, safety, and welfare of the community. <br /> 6 . The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply generally <br /> to other. property in this zoning district: that granting <br /> the variances would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br />� convenience to the applicant, but are necessary to alleviate <br /> a demonstrable hardship or difficulty; are necessary to <br /> preserve a substantial property right of the applicant; and <br /> . would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> Page 2 of 5 <br />
