Redmond <br /> 2695 Casco Point Road <br /> Wavzata, MN 55391 <br /> RE: Lakeshore Retaining Wall <br /> Dear Mr. Redmond: <br /> It has come to the attention of the City that you have contracted with Sanders Landscaping to <br /> alter the retaining wall and grade on your lakeshore. City ordinances prohibit construction, <br /> grading, tree removal and hardcover within 75' of the Ordinary High Water Level of the lake. <br /> When the wall was originally constructed it was done without City approval. When the Ciry <br /> Council did grant a conditional use permit for the wall, it was under specific conditions. <br /> Enclosed is a copy of the resolution for your review. This resolution is also filed on the Chain <br /> of Title for the propeny and sh�uld have been brought to your attention at closing. <br /> You have the right to ask City Council to approve alterations to the wall, but it was a difficult <br /> after-the-fact application the first time and it would again be a very difficult application to <br /> approve. The application process can take from 6 weeks to many months. Therefore, the City <br /> must require you to return the wall`to the height approved by Resolution No. 2538, plantings <br /> must be restored and hardcover under the sand blanket must be removed. A deadline of August <br /> 22, 1994 has been established for completion.
