A buitding permit application has been filed for a zoning permil for a property located at <br /> ��7 (�JCQ PI- �l. the ("Subject Property'), legally described as �-t�t- 135� Sn,�r1Q 1�ctV�- , <br /> Hennep�n County Minnesota. <br /> 2. Owner requests the City to review this application. <br /> 3. The City wiA commence its review of!he appticafion and incur costs associated with said review <br /> only if the Owner estabiishes an escrow to ensure reimbursement to the City of its costs. <br /> NOW TH�REFORE,THE PARTIES AGREE AS FOLLOWS: <br /> 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously wRh the execution of this Escrow <br /> Agreement, lhe Owners shall deposit $ 2`�CjG with the City. All accrued interest, if any, shall be paid to the <br /> City to reimburse!he City ior its cost in administering the escrow account. <br /> 2. PURPOSE OF ESCROW.The purpose of the escrow is to guarantee reimbursement tv the City <br /> for all out-of-pocket costs lhe City has incurred (including planning, engineering or legal consultant review)or wlll <br /> incur in revlewing the plan. Eligible expenses shall be consistent with expenses the Qwners woutd be responsible <br /> for under a zoning permlt application. The escrow witl also guaranlee reimbursemont to the City for afl out-oi- <br /> pocket costS the City has incurred to assure that the work fs completed in accordance with the Slormwater <br /> Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may afso be <br /> used by the City to eliminate any hazardous conditions assaciated with the work and to repalr any damage to <br /> public property or ir�frastructure that is caus b the work (including plannfng, engineering, or legal consUltant <br /> review} associated with permlt # 1,014-�� if compliance with the approved zoning permit Is not <br /> accomplished. <br /> 3. MONTHLY BILLING. As the City receives consultant hills for incurred costs, the CI1y will in tum <br /> send a bill to the Owners. Owners shall be responsible for payment tv the Cily within 30 days of the Owners' <br /> receipt of blll. <br /> 4. DtSBLIRSEMENI'FROM ESCROW ACCOUN'1'. In the event tha2 the Ownets do not make paymont <br /> to the City wilhin the timeframe ouUined In#3 above, shall issue a Stop Work Order untl! the Owners pay all expenses <br /> invaced pursuant to #3. The City may draw irom the escrpw account without furlher approval ot the Owners to <br /> reimburse the City ior eligible expenses the City has incuned, <br /> 5. CLOSING ESCROW. CERTtFY UNPAID CHARGES.
