The proposed residence will meet all .setback and hardcover <br /> ' requirements of the Zoning District . <br /> 6. The City Council has considered this application including <br /> the findings and recommendations of the Planning <br /> Commission, reports by City staff, comments by the owner and <br /> the effect of the proposed variance on the health, safety <br /> , and welfare of the community. � <br /> 7. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to <br /> other property in this zoning district: that granting the <br /> . variance would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other hazard or other <br /> danger to neighboring property; would not merely serve as a <br /> convenience to the owner , but is necessary to alleviate a <br /> • demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property riqht of the owner; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a <br /> variance to Municipal Zoning Code Section 10. 24 Subd . 5 (B) to permit <br /> the construction of a residence on a property with I7,400 square feet of <br /> area instead of the required 43 , 560 square feet of area , approve a Iot <br /> width of 100 feet instead of the required 1401 feet, subject to the <br /> following conditions: <br /> - I . No hardcover variance is allowed . Excluding the existing . <br /> gravel driveway, the maximum alloiaable hardcover , <br /> including house , decks , driveway apron, etc . is 2,14PJ <br /> square feet. <br /> 2. No other variances will be allowed on this property. <br /> :i. All required setbacks must be met. _ <br /> 4. Applicant must provide a copy of the executed access <br /> easement agreement between applicant and owner of 975 <br /> • Wildhurst Trail prior to this variance taking effect. <br /> 5.
