The City Council has considered this application <br /> • ' • • including the findings and recommendations of the <br /> Planning Commission, reports by staff, comments by the <br /> owner and the affect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5 . The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply <br /> • generally to other property in this zoning district; <br /> that granting the variance would not adversely affect <br /> � traffic conditions, light, air nor pose a fire hazard or <br /> other danger to neighboring property; would not merely <br /> serve as a convenience to the owner, but is and would be <br /> in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of "the City. <br /> Conclusions, Order and Conditions <br /> Based on the above findings, the Orono City Council hereb� � <br /> . grants variances to Zoning Code Sections 34 . 452 and 34 . 202 to permit <br /> construction of an addition with a 20 ' rear setback instead of the <br /> required 35 ' and to approve 296 square feet of additional hardcover <br /> � over the 3062. 5 square feet maximum allowed in the 75 ' to 250 ' setback <br /> area subject to the following conditions : <br /> 1. That the existing garage and shed on the City right of way <br /> be removed prior to occupancy. <br /> 2 . That• the maximum hardco�er allowed will �be 3 , 358 square <br /> feet. <br /> 3 . No other variances are granted for this structure. <br /> 4 . Proposed house and decks will not encroach on the <br /> lakeshore site line of existing neighbors. <br /> 5 . Authorities granted by this variance run with the <br /> property, not with the owner, but are permissive only <br /> and must be exercised by applicant for a building permit <br /> within. one year of the date of Council approval, or the <br /> varianEe will expire on that date (March 12 , 1985 ) . <br /> 6 . Violation of or non-compliance with any of the terms and <br /> . conditions of "this variance shall constitute a <br /> violation of the Zoning �Code, shall automatically <br /> terminate any authority granted herein, and shall be <br /> punishable as a misdemeanor. <br /> , 7 .
