The City Council has considered this application including <br /> the fimdings and recommendations of the Planning Commission, <br /> reports by City staff , comments by the owner and the effect of the <br /> proposed variance on the health, safety and welfare of the <br /> community. <br /> 5. The City Council finds that the conditions existing on this <br /> ' property are peculiar to it and do not apply generally to other <br /> property in this zoning district: that granting the variance <br /> would not adversely effect traffic conditions, Iight, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the owner , but is necessary to <br /> • alleviate ademonstrable hardship ordifficulty; isnecessaryto <br /> preserve a substantial property right of the owner ; and would be <br /> in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. � <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a <br /> variance to Municipal Zoning Sections34. 552and34. 202to permitthe <br /> construction of a new residence on a property with 11 ,296 square feet in <br /> area instead of the required 27. ,780 square feet of area , approve a lot <br /> ' width of 50 feet instead of the required 109J feet and approve 356 square <br /> feet of additional hardcover instead of the allowed amount of <br /> hardcover at 1 ,887 square feet, subject to the following conditions: <br /> 1 . Prior to the issuance of a building permit , the sheds on the <br /> property must be razed. Prior to the final inspection for the <br /> new residence, the existing house must be razed . <br /> 2. The total improvement of the property is limited to 2,253 <br /> square feet of hardcover or a 366 square feet tiardcover variance <br /> and the owner of the property is hereby advised that the City will <br /> not approve any future improvements that result in additional <br /> hardcover and that i f such improvements are proposed that they be <br /> � counter balanced with the removal of existing hardcover . <br /> e � 3. Open deck must meet 75 foot setback from lakeshore. <br />
