� <br /> ��� <br /> O � O <br /> -��� _ CITY of ORONO <br /> � � <br /> �� '��'1 ' G'�' RESOLUTION OF THE CITY COUNCIL <br /> ��kESH04� NO. _ 5 � � 2 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO ORONO CODE <br /> SECTIONS 78-350, 78-1403, 78-1288 <br /> FILE NO. 08-3367 <br /> WHEREAS, Thomas P. Kubalak and Patricia M. Kubalak, husband and <br /> wife, (hereinafter "Owners") are the owners of the property located at 2623 Casco Point <br /> Road within the City of Orono (hereinafter "City") and legally described as: Lot 141, Spring <br /> Park, Hennepin County, Minnesota (hereinafter "the Property"); and <br /> WHEREAS, Owners intend to remove the existing house on the Property and <br /> construct a new one; and <br /> WHEREAS, Owners have made application to the City for a variance to <br /> Orono Code Section 78-350 to allow a 4 foot by 6 foot portion of an existing deck that is <br /> within the 10 foot side setback from the north property line to be replaced by a screen porch; <br /> and <br /> WHEREAS, Owners have made application to the City for a variance to <br /> Orono Code Section 78-3�0 to allow the roof over the portion of the existing house that is <br /> within the 10 foot setback from the north property line to be replaced by a roof of a different <br /> shape; and <br /> WHEREAS, Owners have made application to the City for a variance to <br /> Orono Code Section 78-1403 to allow an attached garage to be built to replace the existing <br /> detached garage resulting in 17.7 percent structural coverage when the maximum allowed is <br /> 15 percent; and <br /> WHEREAS, Owners have made application to the City for a variance to <br /> Orono Code Section 78-1288 to allow 41.6 percent hardcover in the 75 to 250 foot zone when <br /> 25 percent is the maYimum; and <br /> R'HEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on September 15, 2008, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 � � <br />
