You asked me if a pipe could be installed in the swale on the City property during the reconstruct project, which I did <br /> not approve. <br /> 2. At a later time during the project, you asked the General Contractor to install a pipe in the swale, and they did. <br /> 3. The City agreed to split the cost of sealing your driveway, as a result of concrete color difference during the <br /> reconstruct project. <br /> 4. Once the pipe on the City property was discovered, the City required that it be removed by June 1, 2011, or they <br /> would not reimburse the driveway sealing costs. <br /> 5. The City reviewed it's policy on work within their property, and it has to be completed by the City, or by a Contractor <br /> hired by the City. As a result the driveway sealing cost will not be reimbursed, but be put towards removing and <br /> restoring the pipe and swale. <br /> 6. You contacted me regarding the sealing, and felt that it should be reimbursed. <br /> Following this discussion, the City's position on this issue has not changed.
