, <br /> DATE: June 17, 2009 <br /> TO: Soren <br /> FROM: Scott Oberaigner <br /> RE: Fire Lane located between 2600 & 2618 Casco Point Road <br /> Before we notify Eric Vogstrom (see attached letter) Bill asked that I provide you with some <br /> history of the situation. Please determine if the letter is okay as is, or modify as you see fit and <br /> notify us of any legal issues we should be concerned with. <br /> History: <br /> City of Orono owns the property between 2600 and 2618 Casco Point Road (also called a "Fire <br /> Lane". As a result of the Casco Point Road reconstruction pro}ect more water will be directed to <br /> this fire lane. Mr. Phil Kaster (2600 Casco Pt Rd) was concerned because a swale that once <br /> existed on the fire lane has been filled. As a result any additional water would potentially sit <br /> longer in the wetland on his property versus draining out the swale to the south and could <br /> adversely affect his driveway. <br /> City staff and Jared Ward with Bonestroo met with the Minnehaha Creek Watershed District <br /> (hereafter referred to as the "Watershed") on Friday, June 12, 2009 to inform them the City <br /> would be reconstructing the swale. The Watershed had no problem with the work that was to <br /> start on Monday, June 15, 2009. <br /> City staff noticed irrigation control boxes located on Mr. Eric Vogstrom's property (2618 Casco <br /> Point Road) and suspected there were irrigation pipes and/or electrical wires in the fire lane. On <br /> Thursday, June 11, 2009 Jared Ward informed Mr. Eric Vogstrom of the swale reconstruction <br /> and informed Mr. Vogstrom if there were any irrigation pipes and/or electrical wires in the fire <br /> lane, he should have them moved before any excavation began on Monday, June 15, 2009. Mr. <br /> Vogstrom was also informed if any irrigation and/or electrical was hit during the digging process, <br /> repairs were his responsibility. <br /> Monday, June 15, 2009 the swale was reconstructed by City staff and exposed a irrigation line <br /> and a electrical line that belongs to 2618 Casca Point Rd (Eric Vogstrom). The electrical line <br /> and irrigation line are now exposed and need to be reburied and off of city property. (See <br /> pictures) <br /> Also as a result of the Casco Point Road reconstruction project, a rain garden will be <br /> constructed near the boulevard of Casco Point Road and the fire lane to help filter the water <br /> runoff from Casco Point Road. City staff feels that additional irrigation pipes and electrical will <br /> be encountered. <br />
