It is a misdemeanor for any person to place, deposit, display or offer for sale any fence, goods or other obstructfons upon, over, across or under any �treet ar private road witl�out flrst having obtained a wrftten permit from the city, and then only in compltance in all respechs with the terms and conditlons of such permit, and taking precautlonary measures for the protection of the public. An electrical cord or device of any kind is Included, but not by way of limitation, within the cleflnition of an obstruction. Sec. 18-196. Required. It is a misdemeanor for any person, except a city emplayee acting wfthfn the course and scope of his employment or a contractor acting within the course and scope of a contract with the ctty, to make � any excavation, opening or fiunnel in, over, across or upon a public street or other public property without flrst having obtained a written permit from the clty as provided in this division. , (Code 1984, § 6.15) Sec. 78-966. Prohibition. (a) It Is unlawful for any person to perform or have perFormed the following land alteration activities without a condltlonal use permit issued by the councfl: (1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt or similar earth material within the IimEts of the city. (2) Fill or reclalm any land by depositing such material or by grading of existing land to elevate or alter the existing natural grade. (3) Build, alter or repair any seawall or retaining wal[, or othervvise change the grade or shore of lakeshore properly. (b) All land alterations involving filling and grading shali be perFormed only with clean fill as defined in section 78-1, Granting of such permits is subject to other regulations and prohibitions of this '; Code and other applicable statutes or ordinances of other governmental bodies.
