� �a�o <br /> ��T� �� �RC�I�C� <br /> RESOLUTION OF THE CITY COUNCIL <br /> � � <br /> � G� 6475 <br /> NO. <br /> l"�kF S H O�� <br /> 6) The proposed lakeside deck is not out of character with the neighborhood and will meet <br /> the side, lake, and average lakeshore setbacks. <br /> 7) The Applicant has requested approvals in order to construct an open, upper level deck on <br /> the lake side of the home. The Applicant understands and is hereby put on notice that the <br /> deck: <br /> a) May not be enclosed above or below, <br /> b) May not be expanded in any way without further structural reductions on the Property. <br /> 8) The Applicants' request to increase the structural coverage, hardcover and second story <br /> additions within the side setback will not alter the essential character of the neighborhood <br /> and will result in minimal negative impact on adjacent properties. <br /> 9) The Applicants' request is in harmony with the purpose and intent of the ordinance. <br /> 10)The Applicants' proposal is consistentwith the comprehensive plan; and <br /> WHEREAS, the City Council considered this application at two meetings on <br /> November 24 and December 8, 2014 including the findings and recommendations of the <br /> Planning Commission, reports by City staff, comments by the Applicants and the public, and <br /> the effect of the proposed variances on the health, safety and welfare of the community as <br /> well as the impact on properties in the vicinity; and <br /> WHEREAS, the City Council on December 8, 2014 made the following <br /> findings with regard to the application: <br /> CITY COUNCIL FINDINGS <br /> 1) This application was reviewed as Zoning File#14-3697. <br /> 2) The Property is located in the LR-1C zoning district, where 0.5 acres is the minimum lot <br /> area and 100 feet is the minimum lot width. The Property has approximately 16,994 <br /> square feet (0.39 acre) acre in area and has 47 feet in width at the OHWL and 64 feet at <br /> the 75-foot setback. <br /> 3) The Property is located in Tier 1 of Orono's Stormwater Quality Overlay District and is <br /> limited to 25% hardcover based on gross lot area. <br /> 4) The second story additions to the home are proposed to be constructed over the existing <br /> footprint of the home. The variance to allow construction above the existing footprint of <br /> the home within the 10 foot side setback will alleviate a practical difficulty inherent to the <br /> Property's width and not created by the Applicants. <br /> Page 3 of 7 <br />
