The building permit for subject property <br /> cannot be issued until Lot 1 has been legally separated from Lots 3, 4 and Outlot 1 via Class <br /> I Subdivision review process per the Orono Zoning and Subdivision Codes. <br /> Lots 1, 3, 4 and Outlot 1 currently exist as a single tax parcel, having been combined for tax <br /> purposes some time prior to 1974. The Orono Subdivision Code, Chapter 11, defines "the <br /> division of property previously combined for tax purposes" as a Class I Subdivision, exempt <br /> from platting but permitted to be subdivided by metes and bounds description per the standard <br /> subdivision procedure, which includes review by the Planning Commission at a public hearing, <br /> and subsequent action by the City Council. <br /> An attorney representing Mr. Cloutier was advised of this requirement some time ago by Zoning <br /> Administrator Jeanne Mabusth. Apparently Mr. Cloutier has since filed a deed with the County <br /> transferring ownership of Lot 1, and the County has duly assiQned a separate PID number <br /> pending completion of their review process. Part of the County's process is conf'u�mation of <br /> City approval of the division. The City cannot and will not grant approval for the completion <br /> cf that division until said property has been formally subdivided by the owner, Mr. Cloutier. <br /> Enclosed is a subdivision application for your use. Technically, the application should be made <br /> by Mr. Cloutier. In addition to the required submittals noted, the survey provided must show <br /> Lots l, 3, 4 and Outlot 1, and must show all existing improvements and hardcover on the entire <br /> property, as well as indicating the proposed subdivision. <br /> Telephone (612) 473-7357 • FAX 473-0510 <br />
