The location of the boathouse makes it non-conforming due to the setbacks and <br /> hardcover within 75' of Lake Minnetonka. The structure is not a non- <br /> conforming use. <br /> 6. A hardship has been placed on the property due to the existing location of the <br /> structure 15' from Lake Minnetonka and 10' from the east property line. The <br /> boathouse was built prior to the adoption of the zoning ordinance and before a <br /> building permit would have been required, resulting in the boathouse being a <br /> legally non-conforming structure that could remain on the property during its <br /> useful life. The storm damage occurred prior to the structure's useful life being <br /> exhausted. <br /> 7. The deck located above the boathouse served as part of the structure's roof. <br /> Heavy winds damaged the deck and roof, requiring both to be fully replaced. <br /> Full replacement would require structural repairs to the boathouse to conform <br /> with the State Building Code, to include a new foundation and replacement of <br /> portions of the existing walls. The repairs are necessary to protect against an <br /> unsafe situation by placing a new roof and deck above a foundation not <br /> conforming to the State Building Code. <br /> 8. The City Council finds that the conditions e�sting on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 9. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variances on the health, safety <br /> and welfare of the community. <br /> Page 3 of 6 <br />
