°IV\ <br />o.K o <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5650 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-395, 78-1434 & 78-1435 <br />FILE NO. 07-3304 <br />WHEREAS, Christopher J. Hedberg and Heidi H. Hedberg, husband and wife <br />(hereinafter "the Applicants") are the owners of the property located at 3940 Watertown Road <br />within the City of Orono (hereinafter the "City") and legally described as follows: <br />Attached as Exhibit A, (hereinafter the "Property"); and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-395 to allow the existing barn to be <br />setback 39.6 feet from the side lot line where a 50 foot setback is normally required, and 95.2 <br />feet from the front lot line where a 100 foot setback is normally required; and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1434 to allow the existing 3,000 square <br />foot barn where an oversized accessory building with a maximum square footage of 2,600 s.f. is <br />normally permitted on a property of this size; and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1435 to allow the existing barn to be <br />located at 95.2 feet from the front lot line, slightly ahead of the proposed principal structure, <br />where at least 100 feet and behind the principal structure is the setback normally required for an <br />accessory structure. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />This application was reviewed as Zoning File 07-3304. <br />2. The property is located in the RR -IA, Rural Residential Zoning District which <br />requires a minimum lot area of 5.0 acre and a minimum lot width of 300'. <br />Page 1 of <br />
