The Property contains a variety of natural features including wooded areas, steep <br /> slopes, wetlands, natural drainageways, and discontinuous areas of dry buildable <br /> land. <br /> 5. The proposed plat includes one residential lot, and one Outlot. The residential lot <br /> will be served via an existing private road, which extends northerly off of Sixth <br /> Avenue North. <br /> 6. The Developer has created an outlot between the residential lot and Wolsfeld <br /> Woods. This outlot contains a portion of Wolsfeld Creek which flows into the <br /> property from the northeast and down through the property to the south, and <br /> "Manage 2" classification wetland requiring a 25 foot vegetative buffer and 20 <br /> foot structural setback from the buffer. This wetland and buffer area will be <br /> covered by a Conservation Easement as well as wetland preservation covenants <br /> and easements, wooded area preservation covenants, drainage easements, etc. <br /> Additionally, the intent of the creation of the outlot is for a land donation to the <br /> MN DNR to be an addition to Wolsfeld Woods. <br /> 7. The residential lot contains an existing residence which conforms to the RR-1B <br /> zoning requirements for lot line setbacks. Any newly proposed residence must <br /> meet the RR-1B setback standards (50' front and rear, 30' sides). <br /> 8. The City has no current plans for trails or parks that specifically require <br /> dedication of land from this property. As no new buildable lots are proposed, a <br /> Park Dedication Fee will not be required. <br /> 9. The residential lot has been tested and found capable of providing suitable <br /> primary and alternate sites for an on-site sewage treatment system. Special <br /> precautions, including but not limited to protective covenants as well as physical <br /> barriers during construction activity, must be taken to protect these sites on both a <br /> short-term and long-term basis, as municipal sewers are not projected to be <br /> extended to serve this area of Orono. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the <br /> findings noted above, the City Council of the City of Orono hereby grants Preliminary Plat <br /> Approval for the Minnehaha Creek Watershed District, for a plat per the Preliminary Plat <br /> Page 2 of 6 <br />
