o� o <br />��� <br />CITY ®f ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5633 <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 78-330 & 78-1405 <br />FILE NO. 07-3296 <br />WHEREAS, Terry R. Johnson & Suzanne Johnson, husband and wife <br />(hereinafter "the applicants") are the owners of the property located at 543 Park Lane within the <br />City of Orono (hereinafter the "City") and legally described as follows: <br />Lot 8, Block 6, Minnetonka Summit Park, Hennepin County, Minnesota <br />(hereinafter the "property"); and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Sections 78-330 and 78-1405 to allow 2.0' roof <br />overhangs where 1.5' overhang is permitted as a non -encroachment and where a 10' side setback <br />is normally required; and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-330 to allow the proposed front entry <br />staircase to encroach 1.7' into the required 10' side setback. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 07-3296. <br />2. The property is located in the LR -1B One Family Lakeshore Residential Zoning <br />District which requires a minimum lot area of 43,560 s.f. or 1.0 acre and a <br />minimum lot width of 140 feet. <br />3. The Planning Commission reviewed this application at a public hearing held on <br />June 18, 2007 and recommended approval of the overhang encroachment variance <br />on a vote of 5-0 and recommended approval of the stairway encroachment on a <br />vote of 3-2. <br />Page I of 4 <br />
