i � \ <br />A <br />1,4 <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION <br />GRANTING A SIX MONTH EXTENSION <br />TO THE EFFECTIVE PERIOD <br />OF PRELIMINARY PLAT APPROVAL <br />ESTABLISHED PER RESOLUTION NO. 5489 <br />- FILE NO. 06-3196 <br />WHEREAS, on July 24, 2006, the City Council of the City of Orono (the <br />"City") adopted Resolution No. 5489 granting preliminary plat approval for <br />subdivision of a lot line rearrangement of property located at 1391 Fox Street and <br />1401 Shoreline Drive; and <br />WHEREAS, City of Orono Municipal Code Section 82-117 establishes <br />that preliminary plat approval is effective for one year from the date of such approval, <br />and failure to file a complete final subdivision application within this time period <br />shall be considered as formal withdrawal of the proposed subdivision; and <br />WHEREAS, preliminary plat approval runs with the land, not the <br />applicant; and <br />WHEREAS, as a result of ongoing negotiations between the two <br />applicants, Patrick McNaughton and Edward Hamm, and other factors, preparation of <br />final plat submittals has been delayed. However, the applicants wish to continue the <br />development process per the approvals granted in Resolution No. 5489; and <br />WHEREAS, due to said delays the applicants have requested an <br />extension of the effective period of preliminary plat approval, and City staff have <br />recommended a six month extension to January 24, 2008. <br />NOW, THEREFORE, BE IT RESOLVED by the City <br />Council of the City of Orono, Minnesota, as follows: <br />1. The effective period of preliminary plat approval is hereby extended to <br />January 24, 2008; and <br />2. All other terms and conditions of Resolution No. 5489 are hereby <br />reaffirmed. <br />Page 1 of 2 <br />
