144 <br />°moo <br />Aq <br />F <br />J� <br />CITY of ORONO <br />RESOLUTION OF TrJI[[ Y�COUNCIL <br />NO. <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 78-1435 <br />FILE NO. 07-3288 <br />WHEREAS, Michael Wengler and Gitte Wengler, husband and wife (hereinafter <br />"the applicants") are the owners of the property located at 2420 Fox Street within the City of <br />Orono (hereinafter the "City") and legally described as follows: <br />Lot 12 of Auditor's Subdivision No. 229, Hennepin County, Minnesota <br />(hereinafter the "property"); and <br />WHEREAS, the applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1435 to allow additions to existing <br />accessory buildings resulting in an oversized accessory building situated between the principal <br />structure and the front (street) lot line. <br />Minnesota: NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File 07-3288. <br />2. The property is located in the RR -113, Rural Residential Zoning District which <br />requires a minimum lot area of 2.0 acre and a minimum lot width of 200'. <br />3. The Planning Commission reviewed this application at a public hearing held on <br />May 21, 2007 and recommended approval of the setback variance based on the <br />following findings: <br />a. The property contains 370,109 s.f in area and has 379' in width at Fox Street. <br />b. The setback variance as requested will not negatively impact views of the <br />property and cannot be seen from the street. The proposed use of the <br />accessory structure will not be detrimental to the residential character of the <br />neighborhood. <br />Page 1 of <br />
