The hardcover that will remain in the 0 to 75 foot zone is a corner of the <br />pool and a walkway between doors on the lake side of the house. This <br />hardcover was shown on the original building permit plan as being outside <br />the 0 to 75 foot zone <br />b. The amount of hardcover allowed to remain in the 0 to 75 foot zone will be <br />subtracted from the hardcover allowed in the 75 to 250 foot zone. <br />c. The property has poor soils so the house, pool and pool equipment vault <br />are on pilings. The location on top of the pool equipment vault will allow <br />use of the pilings to support the proposed building. <br />d. The wetland between the street and the pool precludes placement of the <br />building between the pool and the street. <br />e. The pool equipment vault is four feet high. If the proposed building were <br />placed ten feet from the pool the pool equipment vault would be between <br />the building and the pool and would block the view of the pool from the <br />pool house. <br />f The Owners have agreed to modify the proposed building to make it more <br />difficult for someone to dive from its roof into the pool. <br />4. The City Council has considered this application including the findings and <br />recommendation of the Planning Commission, reports by City staff, comments <br />by the applicants and the public, and the effect of the proposed variance on the <br />health, safety and welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air <br />nor pose a fire hazard or other danger to neighboring property; would not <br />merely serve as a convenience to the Owners, but are necessary to alleviate a <br />demonstrable hardship or difficulty; are necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5 <br />
