� O� <br /> O � <br /> CITY of ORONO <br /> ,� .;- � <br /> ti <br /> ti <br /> RESOLUTION OFTH�C�Y�C60UNCIL <br /> ���kESII�¢�G NO. <br /> on the existing lot and a variance to Code Section 78-1 in order to construct a 3ra story <br /> observatory tower where only 2 %2 stories are normally allowed as well as a conditional <br /> use permit pursuant to Orono Municipal Zoning Code Section 78-418 to allow a non- <br /> rental guest apartment within the principal structure, subject to the following conditions: <br /> 1. Council approval is based on the site plan and building plans submitted by the <br /> applicants and annotated by City staff, attached to this Resolution as Exhibit A. <br /> Any amendments to the site plan and building plans which are not in conformity <br /> with City codes will require further Planning Commission and City Council <br /> review. <br /> 2. An as-built grading plan verifying compliance with the building permit, grading <br /> and drainage plans shall be submitted prior to the issuance of a Certificate of <br /> Occupancy for the residence. <br /> 3. Hardcover in the 75-250' zone shall be limited to 2,549 s.f. or 24.1% and •� <br /> hardcover within the 250'-500' zone shall be limited to 1,886 s.f. or 29.9%per the <br /> proposed plan and hardcover allowance summary as depicted on Exhibit A. <br /> Applicants are advised that any future requests to increase hardcover or change <br /> the nature of existing/approved hardcover shall require City approval, and <br /> increases in hardcover will not likely be approved without concurrent reduction in <br /> existing hardcover. <br /> 4. Only one main entryway access to the principal residence shall be maintained in <br /> order to comply with the guest apartment standards. <br /> 5. The utilities for the guest apartment shall not be metered separately from the <br /> principal residence and the apartment shall not have a separate street address. <br /> 6. No rental of the guest apartment shall be permitted. By executing this Resolution, <br /> the applicants expressly agree that the guest apartment shall not become a rental <br /> unit. <br /> 7. Authorities granted by this resolution run with the property not with the <br /> applicants, but are permissive only and must be exercised by obtaining a building <br /> permit for the new construction within one year of the date of Council approval, <br /> or the variance will expire on that date (April 23, 2008). <br /> Pa�e 4 of 6 <br />
