� o� <br /> 0 0 <br /> C ITY of ORONO <br /> ,� : � <br /> ti <br /> �,�� �G�' RESOLUTION OF TH 5C�Y C60UNCIL <br /> `�kESYi�4�' NO. � <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-1 in order to construct a 3ra <br /> story observatory tower where only 2 %z stories are normally allowed; and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a conditional use permit pursuant to Orono Municipal Zoning Code Section 78-418 to <br /> allow a non-rental guest apartment within the principal structure. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono,Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#07-3270. <br /> 2. Tlie property is located in the LR — 1 C zoning district, which requires a <br /> minimum lot area of %Z acre and a minimum lot width of 100 feet. The <br /> applicants' property is .49 acres and has a width of 60 feet. <br /> 3. The Planning Commission reviewed this application at a puhlic hearing <br /> held on March 19, 2007 and recommended approval of the half story and <br /> side setback variance based on the following findings: <br /> a. The property is .49 acres in size when .50 acres is required. <br /> b. The property has a lot width of 60 feet at the shoreline and 75' setback <br /> when 100' is required. • <br /> c. Due to the configuration of the lot and the angle of the home on the <br /> property a corner of the home encroaches into the required 10' side <br /> setback area. <br /> d. The applicants' proposal meets the 30' height limitation and has <br /> resulted in less mass on the property than would normally be allowed. <br /> e.
