� ' <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> RIGHT-OF-WAY <br /> PERMIT AGREEMENT <br /> 1. RIGHT-OF-WAY PERMIT. Subject to the terms and conditions established by <br /> city ordinances and as set forth herein, the CITY OF ORONO ("City") hereby grants a permit <br /> to Bollic and Sons, Inc ("Permittee") to allow the use of publicly owned or managed <br /> rights-of-way for the installation,repair, and maintenance of a sanitarv sewer service at 3165 <br /> Casco Circle . Permittee agrees to the terms of this Right-of-Way Permit Agreement. <br /> 2. PROPERTY. The right-of-way permit is for the right-of-way located in the City <br /> of Orono, County of Hennepin, State of Minnesota, described on the attached Exhibit"A". <br /> 3. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of <br /> this Permit Agreement, the Permittee shall deposit 5 thousand dollars and <br /> no/100ths �( 5,000.00) Dollaxs with the City. All accrued interest, if any, shall be paid to the <br /> City to reimburse the City for its cost in administering the escrow account. <br /> 4. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee <br /> reimbursement to the City for all out-of-pocket costs the City has incurred to repair any damage <br /> to public property, right-of-way, or infrastructure that is caused by the work (including planning, <br /> engineering, or legal consultant review) associated with the installation of a sanitary sewer <br /> service at 3165 Casco Circle . Eligible expenses shall be consistent with expenses the City <br /> would incur to correct any issues related to construction in the City's right-of-way. <br /> 5. CONDITIONS.
