BUILD(NG PERMiT ESCROW AGREEMENT Orono Building Permit#2015-00115,Orono Demciftion Permit#2015-0Q163 and Land Use Application#15-3784 AGREEMENT made this � day of ��'�m��✓� , 20 �5, by and between the CITY OF QRONO, a Minnesota muniapal corporation("City")Tim &Mary Doubek("Owners"}. Recitals 1. A demolition a�d building permit apptications have been filed for demolfion�f the existing principal structure& pool and a buiiding permit appfication for a new sing#e famaly home located at 4565 Bayside Road the ("5ubject Property"), legally described as Lot 2, Block 1, Bayside Berry Farms, Hennepin County, Minnesota. 2. Owners�equest the City to review thls application. 3. The City will commence its review of the application and incur cosis associated with said review onty if the Owner establishes an escrow to ensure reimbursement ta the City of its costs. NOW THEREFORE,THE FARTIES AGREE AS FQLLOWS: 1. REPOSIT OF ESCRaW FUNDS. Contemporaneously with the execution of this Escrow Agreement,the Owners shal!depvsit$2,500 with the City. Ail accrued interest, if any,shall be paid to ths City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW.The purpose of the escrow is to guarantee eeimbursement to the City for all out-af-pocket costs the City has incurred {including planning, e�afneerin�a. in excess of S600, or legal consuJtant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible far under a building permit appiication.The escrow will also guarantee reimbursement ta ft�e City for all out-of-p�cket costs the City has incurred to assure that the waric is completed in accordance with the Stormujrater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may afso be us+ed by the Ctty to eliminate any hazardous oonditions associat+�d with the wark and to repair any damage to public property or infrastructure that is caused by the wo�k (including planning, engineering, or legal consultant review) associated with building permit#2015-00175,demoli#ion permit#2015-001fi3 and land use applicatinn#15-3794 if compliance with the approved building p�rmit is no#�ccompfished. 3. MONTHLY BILLING. As the Ciry receives consultant bills far incurred oosts, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of ihe Owners'receipt of bill. 4. DISBURSEMENT FROM ESCRQW AGCOUNT. In the event that the Owne�s do not make payment to the City within the timeframe outlined in #3 aba�e, shall issue a Stop Work Order until the Oavners pay all expenses invoiced pursuant to#3. The Gty may draw fmm the escrow accaunt without furth@r approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLQ3ING ESCROW. The Bal�nce on deposit in the escraw,if any,shatl be returned to the Owners when ali requirements related to the�roject are complete. City Staff shal!review the terms of this escrvw agreemeni two times per year ta determine whether the requirements of the project have been successfuify compteted and whether it is appropriate to return the funds. Owner may also request the release of the funds,and such funds shatl be released upon City Staff receiving the appropriate verification that all requirements of the project ha►�e been successfully completed. 6. CERT(FY UNPAIO CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred by the City exceed the amount in escraw, the Ciry shall have#f�e right to certify the unpaid balance to the subject property pursuant to Minn.
